The exhaustion of the prison model is a recurring issue in many prison systems. There are many difficulties and shortcomings highlighted in the fulfillment of imprisonment, such as overcrowding, prison or forced idleness of the favorable environment to aggression, the large consumption of drugs and the high rate of recurrence. For discussion of the subject was used qualitative, exploratory, descriptive, deductive and literature based on books and scientific articles related areas. And alternative solutions to the problem, as well as the disbelief in the pursuit of social reintegration of presidiario as more a function of the sentence, first part of society, which still admits severities and pains prison and does not change the thinking about the arrested and their perspective of social rehabilitation, treating it as eternal deleted. Thus, this construct aimed to analyze and discuss the crisis in the Brazilian prison system, clearly an atmosphere of rebellion, corruption, violence and prisoners living in sub-human conditions, these being some of the many problems that people face frightened. This bias is best understood by drawing a parallel between capitalism and social inequality as the backdrop of the current crisis, it is understood that the arrest reflects what is socially station.
